Terms of Service

These Terms of Service ("Terms") govern your access to and use of septillion.website and the subscription web design service ("Service") provided by Septillion Agency ("Septillion", "we", "us"). By visiting the site, booking a call, or starting a subscription, you agree to these Terms. If you don't agree, please don't use the Service.

1. The service

Septillion provides a monthly subscription web design service: we design, build, host and maintain a website for your small business. The standard plan is $149/month for founding customers (price locked for life while the subscription stays active) and $300/month for new customers once founding spots are filled. Exact scope, included page count, and turnaround times are described on the pricing page on the day you sign up; that description, together with these Terms, forms our agreement.

2. Who can use it

The Service is intended for businesses and adults aged 18+. By signing up you confirm you have authority to bind the business you represent.

3. What's included

• Initial design and launch (up to 5 pages in 5 business days from kickoff).
• Hosting on a fast, secure platform.
• Ongoing edits and updates (copy, images, page changes) on a fair-use basis.
• Monthly social posts and basic on-page SEO.
• Performance and uptime monitoring with monthly reporting.
• Up to 30 pages over the life of the subscription, included.

Custom integrations (booking, payments, third-party APIs) that require paid tools or developer time beyond the included scope may incur additional fees agreed in writing before the work starts.

4. Billing & payment

• Subscriptions are billed monthly in advance via our payment processor.
• Prices are in US dollars and exclude any local taxes that may apply.
• The founding price of $149/month is locked for life as long as your subscription stays active and in good standing. A lapsed subscription forfeits the founding rate.
• If a payment fails, we'll notify you. If it remains unpaid for more than 7 days we may pause the service until it's resolved.
• All sales are final; we do not offer refunds for the current billing period.

5. Cancellation

You can cancel any time by messaging us. Cancellation stops future billing at the end of the current billing period; we do not refund the current month. After cancellation, we will:

• Provide a reasonable handover window to migrate your site content.
• Transfer or release your domain (if registered through us) to a registrar of your choice.
• Take the hosted live site offline when the subscription ends.

6. Your content

Everything you provide (logos, photos, copy, brand assets, testimonials, customer data) remains your property. You grant us a non-exclusive, royalty-free license to use it solely to design, build, host and maintain your website while your subscription is active. You are responsible for ensuring you have the rights to use anything you give us.

7. What we build

While your subscription is active, you have full use of the website we build for you, on a domain you own. We retain ownership of the underlying code, design components, page templates and tools we reuse across clients. Custom artwork or copywriting created specifically for your project becomes yours when your account is paid up to date.

8. Turnaround & updates

Initial launch is typically 5 business days from your kickoff call, assuming you provide brand assets and content promptly. Ongoing updates and on-demand changes are handled on a fair, first-in first-out basis during business days. Urgent same-day changes are best requested via WhatsApp.

9. Acceptable use

We won't build, host or promote websites used for anything illegal, hateful, deceptive, exploitative, or designed to harm people. Examples we will not work on include scams, adult content involving minors, disinformation campaigns, and sites that exist to violate someone's intellectual property. We may refuse a project or terminate a subscription on these grounds and refund any unused portion only if we initiate the termination for our own convenience.

10. Third-party services

The Service uses third-party tools (hosting, payments, email, analytics, Cal.com, Crisp Chat, social platforms). Your use of those tools is governed by their own terms. We are not responsible for outages, changes, or data practices of third parties beyond what is described in our Privacy Policy.

11. No guarantees of specific outcomes

We work hard to grow your traffic, calls and bookings, but we don't guarantee specific search rankings, lead volumes or revenue. SEO, conversion and growth depend on many factors outside our control, including your market, pricing, reputation and offer.

12. Confidentiality

We treat your business information as confidential and only use it to deliver the Service. We may reference our work for you (live URL, screenshots, anonymized metrics) in our portfolio and marketing unless you ask us in writing not to.

13. Warranties & disclaimer

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose and non-infringement.

14. Limitation of liability

To the maximum extent permitted by law, our total liability to you under or in connection with these Terms is limited to the amount you paid us in the month in which the claim arose. We are not liable for indirect, incidental, consequential, special or punitive damages, or for lost profits, revenue, data or goodwill.

15. Indemnity

You agree to indemnify and hold Septillion harmless from claims arising out of content you provide, your use of the Service in violation of these Terms, or your violation of any third-party right.

16. Changes to the service or terms

We may update the Service and these Terms from time to time. Material changes will be communicated to active clients before they take effect, and the "Last updated" date will reflect the latest version. Continued use after changes means you accept them.

17. Governing law

These Terms are governed by the laws of the People's Republic of Bangladesh, without regard to conflict-of-laws principles. Disputes will be handled in the competent courts of Dhaka, Bangladesh, unless we agree otherwise in writing.
